1. Acceptance of Terms

By signing up or using Pharmsolutic services through pharmsolutic.com, you confirm that you have read, understood, and agree to all terms herein. If you disagree with any term, please discontinue use.

2. Definitions

• "Pharmsolutic" means Pharmsolutic Co., Ltd., the service provider
• "Member" means individual or legal entity using the service
• "Service" means online pharmaceutical technical consultation via Q&A system
• "Token" means unit representing the right to submit questions

3. Nature of Service

Pharmsolutic provides pharmaceutical technical consultation through online Q&A covering:

• Formulation Development
• Analytical Method Development
• Technology Transfer
• Quality Control & Validation
• Process Optimization
• Pharmaceutical Data Analysis

3.1 New Member Privileges

New members receive 3 Free Consultations upon registration.

3.2 Token Pricing

• 1 Token = 30 Thai Baht (THB)
• Short question = 1 Token
• Long or complex question = 3 Tokens
• Pricing may change with at least 30 days advance notice

4. Disclaimer & Limitation of Liability

4.1 Nature of Responses and Service Provider Credentials

Consultant responses are professional opinions and academic guidance based on information provided by the customer at that time.

The service provider is a licensed pharmacist registered with the Pharmacy Council of Thailand. License information may be verified upon request to the Company. Professional opinions do not guarantee commercial outcomes or legal approvals.

Service Scope: Pharmsolutic responses cover only technical consultation in formulation development, analytical methods, manufacturing, and pharmaceutical quality control for industrial pharmaceutical companies. This service does not cover clinical consultation, medical diagnosis, drug prescription, or individual patient medication advice. For questions outside this scope, please consult relevant medical professionals directly.

4.2 Customer Responsibility

Customer must verify accuracy, suitability, and apply responses to their specific context, considering:

• Applicable regulatory requirements (e.g., Thai FDA, US FDA)
• International standards (e.g., GMP, ICH, USP)
• On-site specialist consultation when necessary

4.3 Liability Limitation

Pharmsolutic shall not be liable for direct, indirect, or consequential damages arising from use of responses, except in cases of clear evidence of gross negligence. In such cases, maximum liability is limited to the Token value used for that specific question.

4.4 Service Exclusions

This service does not replace:

• Regulatory authority inspections
• Legal or IP counsel
• Laboratory analytical testing
• On-site facility audits

5. Intellectual Property

5.1 Ownership

All responses and documents prepared by Pharmsolutic are copyright of Pharmsolutic.

5.2 Customer Usage Rights

Customer has perpetual rights to use responses within their own organization for business purposes, at no additional cost.

5.3 Restrictions

Customer shall not:

• Distribute, resell, or reproduce responses for commercial benefit
• Misappropriate responses as their own work
• Disclose responses to third parties outside their organization without written permission

6. Confidentiality

Pharmsolutic maintains confidentiality of customer information and questions. Details are in the Mutual NDA which customers must accept before each question submission.

7. Refund and Cancellation

• Tokens purchased represent the right to use services only; they cannot substitute for cash or be exchanged for cash
• Exception: If a Company system error prevents customers from using non-expired Tokens normally, the Company will resolve the issue promptly and may, at its discretion, issue replacement Tokens or refund the value on a case-by-case basis
• Unused Tokens expire 1 year from purchase date
• If the Company terminates the service, customers receive refund for unused Token value
• If customer breaches these terms, account may be suspended without Token refund

8. Account Suspension and Termination

Pharmsolutic may suspend or terminate accounts in cases of:

• Breach of these terms
• Use for illegal or unethical purposes
• System hacking, disruption, or destruction attempts
• Inactivity exceeding 24 consecutive months

9. Changes to Terms

Pharmsolutic may update these terms with at least 30 days advance email notice. Continued service use after the new terms take effect constitutes acceptance.

10. Governing Law and Dispute Resolution

These terms are governed by the laws of the Kingdom of Thailand. Any disputes shall be subject to the courts of Bangkok. Both parties agree to attempt good-faith negotiation for at least 30 days before litigation.
